These Terms of Use apply to the B-DAY app and this website, provided by Aleksandr Pavlov. The app is licensed, not sold, and is also subject to Apple's Standard End User License Agreement (EULA). These Terms supplement, and do not replace, the Apple Standard EULA.
1. Acceptance
By downloading or using B-DAY, you agree to these Terms and to the Apple Standard EULA. If you do not agree, do not use the app.
2. The app and website
B-DAY is a local-first birthday organizer for iPhone and Apple Watch. The website provides information about the app and these legal documents.
3. Eligibility
You must be old enough to use the App Store and to enter into these Terms in your jurisdiction.
4. Your data and the people you add
You are responsible for the information you enter, including information about other people (names, birthdays, contact details). You confirm you have a reasonable basis to store and manage that information.
5. Acceptable use
Use the app only for lawful, personal purposes. Do not misuse it, attempt to break its security, or use it to harm others.
6. Free Version
B-DAY is free to use for up to a limited number of people (currently 5).
7. Full Version (one-time purchase)
The Full Version is a one-time, non-consumable in-app purchase that unlocks additional capacity and features. It is not a subscription and does not auto-renew.
8. Payments, restore and refunds (Apple)
In-app purchases are processed by Apple through the App Store; we do not receive your payment card details. You can restore a previous Full Version purchase using the same Apple ID. Refunds are handled by Apple under Apple's policies.
9. Platform availability
Optional features rely on Apple services (iCloud/CloudKit, notifications, widgets, Apple Watch). Their availability depends on your device, settings, and Apple's services, which we do not control. Notifications are local reminders; we do not guarantee delivery timing.
10. Backups and your responsibility
You are responsible for your own backups and exported files. We are not responsible for data loss; keeping iCloud and/or device backups is recommended.
11. Intellectual property
The app, its design, and content are owned by Aleksandr Pavlov or its licensors and are protected by applicable laws. Except as permitted by the Apple Standard EULA or applicable law, you may not resell, redistribute, or reverse-engineer the app.
12. Disclaimer and limitation of liability
The app is provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
13. Changes and termination
We may update these Terms; continued use after an update means you accept the revised Terms. You may stop using the app at any time by deleting it.
14. Governing law
These Terms are governed by the laws of Georgia, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your country of residence.
